1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and StepStation, operated by Ethan Gale ("StepStation," "we," "us"). They govern your use of stepstation.app and the StepStation apps (the "Service"). By creating an account, starting a purchase, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
You must be at least 13 years old (16 in the EEA and UK) to use the Service, and old enough to form a binding contract where you live (or have a parent or guardian's permission) to make purchases.
2. Health & safety
StepStation is not a medical device and does not provide medical advice. Steps, distance, calories and other figures are estimates and may be inaccurate. Don't rely on them for medical, diagnostic or treatment decisions.
Consult a physician before starting any exercise program, especially if you are pregnant or have a heart, joint or other medical condition. Stop exercising and seek help if you feel pain, dizziness, faintness or shortness of breath. Use treadmills and walking pads according to the manufacturer's instructions, and stay aware of your surroundings. Don't use the app in a way that distracts you while walking. You exercise at your own risk.
3. Accounts
You can use StepStation as a guest, with data stored only on your device, or create an account to sync across devices. You're responsible for keeping your login credentials secure, for activity under your account, and for giving us accurate information. Tell us right away at support@stepstation.app if you suspect unauthorized use. Guest data isn't backed up by us. If you clear your browser or lose your device, it may be lost.
4. Plans, billing & automatic renewal
StepStation offers a free plan and paid plans: Pro Monthly, Pro Annual, Teams, and a one-time Founder pass, when available. Current prices and features appear in the app before you buy. Prices are in U.S. dollars unless shown otherwise, and taxes may be added where required.
Subscriptions renew automatically. By starting a Pro or Teams subscription, you authorize us, through our payment processor Stripe, to charge your payment method at the start of each billing period (monthly or yearly) at the then-current price until you cancel.
- Free trials. Where a trial is offered (for example, 7 days on Pro Annual), you won't be charged until it ends. Unless you cancel before the trial ends, your subscription will begin and you'll be charged automatically. The charge date is shown at checkout. Trials are limited to one per person.
- Price changes. We'll notify you at least 30 days before a price change applies to your subscription. The change takes effect at your next renewal, and you can cancel before then.
- Failed payments. If a payment fails, we may retry it and pause paid features until it's resolved.
- Reminders. Where required by law, we'll remind you before an annual renewal or before a trial converts to a paid plan.
5. Cancellations & refunds
How to cancel: Settings → your plan → Manage subscription, which opens the Stripe billing portal, or email support@stepstation.app. Cancellation takes effect at the end of your current billing period, and you keep paid features until then.
Except where the law requires otherwise, payments are non-refundable and we don't give partial refunds for unused time. That said, if something went wrong, such as a charge you didn't expect, email us within 14 days and we'll make it right. EEA/UK consumers: you have a 14-day right to withdraw from a purchase. By starting to use paid features immediately, you ask us to begin providing them during that period, and a refund may be reduced in proportion to the time used.
6. Founder pass
The Founder pass is a one-time purchase, available in limited quantity, that unlocks Pro features on your account for the lifetime of the Service. That means for as long as StepStation operates, not for your lifetime or any fixed period. It is personal to your account and not transferable. If a Founder purchase is refunded or charged back, the pass is revoked. If we ever shut down the Service, we'll give at least 60 days' notice and a way to export your data.
7. Groups & Teams
Groups let members share progress. The person who creates a group or buys Teams ("admin") manages its settings and members, and is responsible for the Teams subscription. Teams benefits extend to members only while the subscription is active. Admins who connect a chat webhook (e.g. Slack) confirm they're authorized to post to that workspace. Members can leave a group at any time. Deleting a group removes it for everyone.
8. Your content
You own the data and content you add, such as walks, names, photos and group names ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process and display Your Content only as needed to operate and improve the Service and to show it to people you choose to share with. This license ends when you delete Your Content, except for residual backup copies, which are deleted on our normal schedule. You confirm you have the rights to anything you upload.
If you send us feedback or suggestions, we may use them without any obligation to you.
9. Acceptable use
Don't:
- upload unlawful, harassing, hateful, sexually explicit or infringing content, including in names and profile photos;
- impersonate others, or harass or spam other users or groups;
- falsify activity in a way meant to mislead other members, such as in competitive groups;
- access other people's accounts or data, or probe, scan or break our security;
- reverse engineer, scrape, overload or disrupt the Service, or get around feature limits or payment;
- resell the Service or use it to build a competing product.
10. Third-party services
The Service works with third-party services such as Google sign-in, Stripe, wearable providers and Slack. Their own terms and privacy policies govern your use of them. We aren't responsible for them, and they may change or stop working with StepStation.
11. Our intellectual property
The Service, including its software, design, themes, badges, logos and the StepStation name, is owned by us and protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal or internal-team use under these Terms. Copyright concerns can be sent to support@stepstation.app with the details required by the DMCA (17 U.S.C. § 512(c)(3)).
12. Suspension & termination
You can stop using the Service and ask us to delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if required by law, or to protect users or the Service. Where reasonable, we'll give notice and a chance to export your data. Sections that by their nature should survive termination (such as 8, 13–16 and 18) will survive.
13. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of any step, distance, calorie or other data. We don't guarantee the Service will be uninterrupted, error-free, or that data will never be lost. Keep your own exports of anything important.
14. Limitation of liability
To the fullest extent permitted by law, StepStation and its operator will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of data, profits or goodwill, or for any personal injury arising from exercise, arising out of or related to the Service. Our total liability for all claims is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.
Some jurisdictions don't allow certain exclusions or limits, so some of the above may not apply to you. Nothing in these Terms limits liability that can't be limited by law, such as for fraud, gross negligence, or death or personal injury caused by our negligence, and nothing affects your statutory consumer rights.
15. Indemnity
To the extent permitted by law, you agree to defend and indemnify us against third-party claims arising from Your Content or your breach of these Terms or the law.
16. Disputes & governing law
Most concerns can be resolved quickly. Please email support@stepstation.app first and give us 30 days to try to fix things informally.
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be brought only in the state or federal courts located in Dane County, Wisconsin, and you and we consent to their jurisdiction. Either party may instead bring an individual claim in small-claims court. If you are a consumer in the EEA or UK, you may also bring proceedings in your home country, and mandatory consumer protections where you live still apply.
17. Changes to these Terms
We may update these Terms. We'll change the "Last updated" date and, for material changes, notify you in the app or by email at least 14 days before they take effect. Continuing to use the Service after that means you accept the new Terms. If you don't, you can cancel before the change takes effect.
18. General
These Terms and the Privacy Policy are the entire agreement between us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. You can't transfer these Terms without our consent. We may transfer them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond reasonable control.
